Terms
Upon acceptance of Scoopin’Up LLC’s written Proposal and Estimate (for Commercial clients) or online Fee Quote (for individual clients) – collectively referred to as “Services” – these Services will continue indefinitely on a recurring basis until cancelled as outlined in these Terms of Use.
Cancellation
Clients may cancel their Services at any time with 24 hours’ notice, for any reason, without incurring a cancellation fee or penalty. To request cancellation, please call or text (984) 256-1480, email service@scoopinup.com, or use the cancellation link in the Client Portal (available only for residential customers). Any payment for Services rendered before cancellation and owed by the Client must be paid upon termination of the Services. If the Client has been using a promotional offer (e.g., 10% off for a 6-month prepaid service) and cancels before completing the promotional period, the promotion will no longer apply. The Client will be refunded for the unused portion of the prepaid service, but no promotional discounts will be applied.
Payment Method
At the time of accepting the Services, the Client shall provide Scoopin’Up LLC with credit card or ACH information for processing payment according to the terms of this Service Agreement. The Client consents to Scoopin’Up LLC storing their credit card information and charging the card for any fees owed under this agreement. If the Client’s credit card or ACH information fails, additional fees may apply. If the Client does not provide an updated payment method within five (5) business days of being notified by Scoopin’Up LLC of the failure, Scoopin’Up LLC reserves the right to terminate the Service Agreement.
Consent to Contact
By providing your cell phone number and/or email address, you consent to receiving calls or electronic communications at the number or email address provided, including but not limited to communication attempts such as calls, text messages, emails, or other electronic means, which may be made using an automated dialing system, prerecorded messages, or artificial voice. This consent applies to Scoopin’Up LLC and its affiliates, including any third-party entities engaged by Scoopin’Up LLC for billing, collections, or customer care services.

Refunds
Scoopin’Up LLC does not provide refunds for services paid unless the cause is an error on our part. In cases where a refund is issued for any reason other than our fault, it will be issued minus any applicable bank/credit card processing fees and any proration of services, if applicable. Account credits may be issued on a case-by-case basis and will either be applied to the following month’s invoice or remain on the client’s account indefinitely without expiration.
Modifications
Any modifications to the Services or these Terms of Use will be communicated to the Client in writing. Additional charges may apply for any changes. Scoopin’Up LLC will provide the Client with at least 30 days’ notice of any price adjustments.
Service Day and Arrival Windows
Scoopin’Up LLC cannot guarantee time-specific visits due to various factors. Our service hours are from sunup to sundown, and we operate in most weather conditions. If weather or road conditions become unsafe, services may be paused until conditions improve, and affected clients will be notified promptly. Occasionally, Scoopin’Up LLC may need to reschedule or adjust your service days at its discretion. Service days are determined by the client’s address and established routes, allowing us to maintain competitive pricing. Client’s monthly fee covers certain holidays observed by Scoopin’Up LLC without compensation for the cost or service. Service interruptions due to weather conditions (such as snow, heavy rain, high winds, hurricanes, extreme temperatures, or other unforeseen events) or causes beyond our control may occur. Clients may cancel or pause services during such interruptions, but additional charges may apply when services resume. Scoopin’Up LLC will perform the services on the specified date(s) or day(s) of the week, unless otherwise notified. Please ensure that the gate or access point is clear of any obstructions (e.g., dogs, padlocks, lawn furniture) and is unlocked. If Scoopin’Up LLC is unable to access the yard, the client will be notified and charged for the visit.
Aggressive Animals
Scoopin’Up LLC will work with friendly animals in the yard; however, we will not work around aggressive animals. Clients will receive a notification approximately 30 minutes before service, followed by another notification when a Scoopin’Up LLC technician has arrived. If aggressive animals are not properly secured, Scoopin’Up LLC will make one more attempt to contact the client and knock on the door. If there is no response within 5 minutes, the service will be skipped, and the client will be charged for the visit. If Scoopin’Up LLC is unable to access the yard or complete the cleanup due to an aggressive animal, the client will be notified and charged for the visit. If a Scoopin’Up LLC technician is bitten by any animal, the technician will immediately leave the premises to seek medical attention. The yard will be left in its current condition, and the visit may be considered as completed for that day. The client will be responsible for all medical fees. Depending on the situation, animal control may be contacted, and additional actions may be taken. Clients must maintain accurate vaccination records for their dogs and make them available to Scoopin’Up LLC if requested, or in the event of an incident involving a dog bite or attack on a technician. Scoopin’Up LLC relies on the client’s assessment of their animal’s temperament for the safety of our team. Scoopin’Up LLC reserves the right to refuse service to any yard where our technicians feel unsafe.
Service Delays
“If the Client fails to make a scheduled payment, Scoopin’Up LLC may delay the performance of Services and will resume only once all outstanding amounts are paid. If Services are suspended and the Client does not pay in full within 30 days, Scoopin’Up LLC will consider the Services terminated. Certain events beyond the control of Scoopin’Up LLC, such as snow, heavy rain, strong winds, hurricanes, extreme temperatures, actions of governmental authorities, or other unforeseen circumstances, may impact the ability to fulfill the Services. In such cases, Scoopin’Up LLC will not be held liable and may choose to postpone, cancel, or terminate the Services as needed. Delays due to such events will not be considered abandonment of the agreement.
Disputes
This Service Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina. If any dispute or claim arises out of or relates to this Agreement or its breach, and if such dispute or claim cannot be resolved through direct discussions, the parties agree to resolve the matter through mediation administered by the American Arbitration Association, pursuant to its Construction Industry Mediation Rules, before proceeding to arbitration. Any award rendered by the mediator(s) or arbitrator(s) may be entered as a judgment in any court with proper jurisdiction. The parties may mutually agree to resolve the dispute through mediation and arbitration conducted by the Better Business Bureau (if applicable), instead of the aforementioned process. Efforts by Scoopin’Up LLC to collect any amounts due, or any portion thereof, are excluded from the mediation and arbitration provisions outlined above. The Client agrees to cover all collection expenses, court costs, and reasonable attorney’s fees incurred by Scoopin’Up LLC in such collection efforts. The Client waives any and all rights to a jury trial in any legal action or proceeding related to this Agreement.
No Waiver of Rights
Scoopin’Up LLC’s failure to exercise any right or remedy, or its acceptance of partial or late payment, shall not be considered a waiver of any of Scoopin’Up LLC’s rights or the Client’s obligations under these Terms of Use. Such actions shall not constitute a waiver of Scoopin’Up LLC’s right to declare a default, either immediately or in the future, under these Terms of Use.
Entire Agreement
These Terms of Use represent the complete and exclusive agreement between the parties regarding the Services and supersede all prior or concurrent written and oral agreements or understandings related to the subject matter herein.
